Imphal, 31 March 2016 : The sessions judge Imphal west M. Manojkumar Singh also did not allow the accused Th. Herojit Singh to make any disclosure. In the order issued today the sessions judge maintained that the court is not in a position to allow the accused Th. Herojit to make any disclosure whatever he wants at this stage of trial. The order said he has to wait till his examination under section 313 Cr PC. The order said it is settled principle of law that recording of confessional statement under section 164 Cr PC shall be made during the period of investigation only and it cannot be done after the commencement of trial. It may be recalled that the accused head constable Th. Herojit requested the district and sessions court on the 24th of last month to allow him make confessional statement on the Sanjit Rabina fake encounter case. The counsels for Herojit and Taratombi left the court soon after the cases were dismissed.
